DLSE manager continues to harass blogger, continues to delay wage claims, and continues to thumb his nose at the Corrales decision...

DLSE supervisor Jorge Gomez has nothing but time to harass the blogger, despite the fifty-eight (58) wage claims that need his signature for 98a wage claim hearings. This picture was taken on my own time, using my own equipment, and I physically counted each and every DLSE 540 (otherwise known as the transmittal), the last step before Jorge Gomez approves it for a 98a hearing. Here these wage claims collect dust while Jorge Gomez tries to rub some stink on the blogger.

Instead of processing the very claims that got DLSE into trouble with the Corrales decision, he secretly reviewed twenty (20) wage claim case files assigned to the blogger. You know what Gomez discovered during his secret review? That the blogger was doing the job. A huge waste of time on the part of Jorge Gomez, time he (supposedly) doesn't have. The blogger will continue to document how Jorge Gomez spends his day, and the blogger will continue to broadcast the harassment and the inefficient service to the taxpayer.

Jorge Gomez is a documented failure: he can't process wage claims in a timely manner, he couldn't bring Mary Tokar to an acceptable level of performance, he couldn't bring Vicki Tamoush to an acceptable level of performance, he cannot bring his office to an acceptable level of staffing to efficiently serve the public, and he lets his office favorites cherry-pick the easy wage claims. It seems that the only thing he knows how to do is to secretly review the case files of the only state employee who dared to question & broadcast their wrongdoing.

Denise Padres, Angela Bradstreet, John Duncan, Richard Munoz, Vanessa Holton, and Steve McSquinty: I took the photo, not on state time and not using state equipment. Don't waste my time & the taxpayers money by forcing me to attend another 9-minute internal affairs investigation in Los Angeles. You jackasses have this information, so stop wasting funds that are not yours to waste. Why don't you losers stop harassing me and take a decisive course of action, one way or the other? California Supreme Court Justice Kennard praised Angela Bradstreet for her ability to mediate & resolve disputes; so far, Kennard seems ignorant of this issue occurring on Bradstreet's watch.

DLSE Employee Retention Guru Jorge Gomez does it again, and again, and again, and again

Currently, DLSE Santa Ana supervisor Jorge Gomez has failed to fill the vacancy created by Office Assistant Veronica Gutierrez's departure. Currently, DLSE Santa Ana supervisor Jorge Gomez has failed to fill the vacancy created by Hearing Officer Vicki Tamoush's departure.

The moron cloud hanging over him continues to darken. Recently, Office Assistant Maribel Zaragoza passed the Office Technician (OT) promotion (congrats). What Dumbo doesn't understand is that she's looking to get promoted: that's why she took the test, it's a combination of ambition and talent. She wants to stay here, so she asks him what he's done about turning her position into an Office Technician position (so she can remain). He tells her that he hasn't done anything, and she needs to do what she needs to do to take care of #1. She tells him that she's had offers, and he basically told her to go somewhere else because he hasn't done squat to keep her as an OT.

If she leaves, that means only 3 DLSE staff speaking Spanish at the counter: Jesus, Esperanza, and Jorge Gomez. Maybe it's his destiny: to drive people out of the office until he's the only Wage Claim Spanish-speaking employee. He has the chance to keep Maribel and he's taking a big, fat dump on retaining a good employee who speaks Spanish.

The one Commenter had it right; DLSE is nothing more than a management fertilizer factory. Dumbshit, after dumbshit, after dumbshit. Jorge Gomez won't be happy until both Spanish-speaking clerks are gone and there's still a vacancy for the 3rd Hearing Officer. Who cares, right? It's only the biggest wage claim office in the state, why bother staffing it? The reason why it's the busiest wage claim office is because the TAXPAYERS made it that way, you friggin' morons!

Jorge Gomez moved his entire family to Stockton, CA to take a  labor standards promotion.

Gomez knows next to nothing of Esprit de Corps, camaraderie, honor, integrity, and courage.  Courage isn't bending over for your bosses in hopes of getting the next promotion.  Maybe that's why Gomez only wants women in his office, maybe he has something against ex-military servicemen.  He was certainly shaken when his daughter joined the US Air Force.

Positive and successful office relationships improve service to the public.  During the failed Senate confirmation beat-down of Robert Jones, it was highlighted that Jones destroyed office morale.  The Senate Rules Committee made note of it, so for Regional dipshit Abigael Calva to allow Jorge Gomez to act in a manner that does a disservice to the public being served in Santa Ana is contrary to what Senate Assembly Members desire from state employees.

Calva, for years, allowed and still allows Jorge Gomez to fcuk the Santa Ana office with Mary Tokar's and Vicki Tamoush's continued employment without proper supervision. Tokar retired and Tamoush transferred before Gomez took corrective action, so what does that say about Calva and Gomez?

Gomez is unfit to be a supervisor, as he doesn't supervise, he just bends over, and not for the taxpayer, just for his own self-serving preservation, career, and hopes of being promoted.  He's not smart enough to figure out that he'll never get promoted, as they failed him on the DLC IV exam and passed & promoted that noob Eric Rood, whose about 10 years out of high school.  Someone who's dumb enough not to read the writing that's on the wall is unfit to supervise the busiest wage claim office in California...give him something more his speed, like El Centro or Winterhaven.

DLSE mgr. Jorge Gomez takes another crap on another employee...this time, Vicky Tamoush is leaving the DLSE. Mr. Gomez should leave, as he has failed.

Santa Ana office supervisor Jorge Gomez lost another substandard public servant, but the worst substandard public servant in Santa Ana still collects a paycheck.  Who?  Jorge Gomez.  Vicky Tamoush would still be here if Jorge had properly supervised her.  When she screwed up, and it was often, all he had to do was to crack the whip and warn her not to do it again.  Instead, he shirked his supervisory duties and chose cowardice over supervision.  Jorge Gomez is a supervisor, and he failed to supervise.  His working title wasn't "coward," though one would think he is paid to avoid issues and concerns.

At the end of the day, his job was to increase Vicky's level of performance to the public.  Jorge Gomez failed as a supervisor because her performance became so substandard that she left the DLSE.  Without detracting from Vicky's faults, there are no bad employees, only bad supervisors.  His job was to monitor and evaluate performance.  His job was to communicate deficiencies.  His job was to take corrective action, if needed.  Jorge Gomez stacked the deck against Vicky Tamoush and probably told her to leave (or else).  Vicky Tamoush didn't turn into shit overnight, and that's why Jorge Gomez is to blame.    In this respect, Jorge Gomez has failed miserably, and this wasn't his first substandard employee.

Based upon my investigation, Jorge Gomez has known about Vicky Tamoush's departure for at least two weeks.  They have failed to schedule her hearings, knowing that she'll be leaving.  She had her custom desk removed from the state building, and Jorge Gomez kept this a secret.  Jorge Gomez is good at keeping secrets, but as with any secret, it eventually leaks.  My secret is that I know how Jorge leaked it.

A similar situation happened to Mary Tokar, who retired before Jorge Gomez could correct her identified deficiencies.  Jorge Gomez had 15 years to bring Mary up to par, and he failed there, too.  15 years and he couldn't get it right.  By my math, DLC Mary Tokar retired and DLC Vicky Tamoush transferred out of the DLSE within the last five months of each other.  It seems that Jorge Gomez does not know how to manage, but it seems that he does know how to be a coward and he does know how to create the worst office morale in any state agency.  Oh yeah, today is his wedding anniversary; at least he's kept that together.

Screwing over the taxpayer, in classic Santa Ana hearing officer Vicki Tamoush fashion

When Vicki Tamoush isn't invoking her own strange justice in wage claims, she has the chance to play games with BOFE citations.  LT wrote this one citation to a car wash, and the car wash owner appealed the citation.  Vicki Tamoush attempts to flim-flam the owner by tricking him into signing a time statute appeal waiver, so this way she can continue the hearing and nail the owner to the tune of $10,000.  The owner asks her to explain what he's about to sign, she mumbles something he doesn't understand (apparently hearing officer Tamoush cannot properly explain a citation waiver), so he refuses to sign what he doesn't understand.

Tamoush has no choice but to dismiss the citation because DLSE took too long in scheduling it.  Tamoush knows that she cannot hold the hearing unless the owner signs the time waiver, but instead of dismissing it as required, she sadly attempts to circumvent justice by tricking him into signing it.  This is another flagrant example of a classic DLSE/DIRt/LWDA butt-lick: someone who knows the law and knows better but deliberately acts contrary to the law or ethical codes of professional public service.  Tamoush also waited until the day of the citation hearing to attempt this hoodwink.  This garbage goes on all day because Jorge Gomez and Abigael Calva allow, permit, and condone Tamoush's boorish behavior against the taxpayer.

Tamoush's performance evaluation will mention NOTHING about the legal complaints made against her, against the dozens of Spanish claims she delayed when she used her friend Mindy to translate, and it will mention NOTHING about how she calls off sick on days she holds hearings, thus screwing over the DLSE again and burdening the taxpayers with more waste, fraud, and abuse.

Our own Labor Commissioner didn't know how her own game is played, yet these are the morons who are appointed. Spring time is coming up; let's hope that someone prints out a couple pages of this blog to give to the senators who are in charge of her political appointment.

Regional Moron Manager Abigael Calva came to Santa Ana on Firday, 01/18/08, to chew the fat with the ladies working at the Santa Ana office. This also includes supervisor Jorge Gomez, not really a woman. She's very busy bending over for Angela Bradstreet, as it was Angela that told Abigael Calva to re-schedule this hearing.

Labor Commissioner Angela Bradstreet has been sitting on her lazy ass doing nothing about this complaint made against Vicki Tamoush. Read all 6 pages. So Santa Ana is in the throes of the safety barrier being installed, and construction was halted because of possible asbestos issues. Nice, huh? Spend millions on CMS and keep the slaves working near potentially undisturbed asbestos. During this construction, some offices have been moved. One of these changed offices was soon-to-be Veronica Gutierrez, who switched it with a break room connected to Vicky Tamoush's courtroom. So Vicky, being up Jorge Gomez's ass for most of her career, tells Jorge that the next clerk he should hire (who will be adjoining Vicky's court room) should be more like Tess Morales or Ha Lee, so that the next secretary doesn't get the attention from the "boys" in the office like Veronica and Maribel.

What did I tell you about Vicky Tamoush not liking attractive females? Not only does Jorge entertain such racists & geriatric statements (Vicky advising Jorge to hire old Asian grandmothers as opposed to young Hispanic females), but Jorge entertains Vicky's vomit of bullsh*t. There's a reason why Jorge has only 3 men in his office (versus 11 females): he's a gender-centric, weak manager that cannot manage.

Vicky has a lock on her door because that's what Jorge wants: Bruce doesn't have a lock on the door because that's what Jorge wants. Vicky has her hearing office set up like a court room because that's what Jorge wants. Vicky doesn't get investigated for treating the attorneys of Boeing like dirt because that's what Jorge wants. Jorge has cherrywood furniture while everyone else has prison-made oak because that's what Jorge wants. Jorge sucks up eats with his boss, but that double standard doesn't exist in his office. On any normal day, Jorge eats with his friends...alone. Almost 30 years on the job and he still eats lunch alone. Sad, but abestos-free.

Commissioner Badstreet quoted in LA Times, praising a private company that's doing DLSE's job; she should divert CMS budget to this productive agency!

The Maintenance Cooperation Trust Fund, a watchdog agency modeled after labor compliance programs in the construction industry, is doing the job that DLSE is budgeted to do, so Bradstreet should divert some of her CMS budget to an agency that actually works and produces results. I was "shocked" when Angie baby was quoted in the Los Angeles Times (molly.selvin@latimes.com) but this somehow failed to hit her propaganda press release...maybe because it portrays Bradstreet's DLSE as a bunch of boobs.

The Maintenance Cooperation Trust Fund (MCTF) and their investigators are often former janitors. State Labor Commissioner Angela Bradstreet hails Garcia as a "passionate, delightful and effective advocate in fighting the underground economy." Who in the heck describes an advocate as "delightful" these days? Badstreet should have also stated, "I manage DLSE, but we're so effed up that the MCTF does a way better job than us, and they do it with less money. It's tea time; would you like some of me crumpets; they're delightful. Fighting the underground economy is so hard because it's underground; they're hiding from me employees, so me results tisn't as good as MCTF. Scone, anyone?"

Today, a kid broke into tears because she needed her entertainment work permit tomorrow. Per Angela Bradstreet: kids that want to star in dog food commercials are at the bottom of our priority, since our mission is to process wage claims. Also, some guy came to the office to complain that the office didn't answer the phone; he accused us of giving him a fake telephone number. After one deputy told him (for the third time) that the number was operational, but unfortuantely we were busy, he decided to ask me the same thing, where I told him the same thing. I'm sure he'll be writing to Governor to complain, since he never bothered to tell anyone why he was at the office, so no one knew his purpose for being there, other than to complain that no one answered his phone call.

Oh yeah, I almost forgot....someone made another complaint against Hearing Officer Vicky Tamoush! The email complaint was cc'd to both Jorge Gomez (JGomez@dir.ca.gov) and Angela Bradstreet (ABradstreet@dir.ca.gov); I have no doubt that Bradstreet will continue to suffer from cranial rectal inversion and collectively ignore all of the complaints made against Tamoush! You go girl! And take those tacky shoes with you!

Another hearing officer Vicki Tamoush, "serving the public" style to upset both employee & employer taxpayers

Since the DLSE has no policies and procedures for wage claim conferences [note: not the 98a hearing, described in the Labor Code, this is the informal settlement conference before the hearing], what we have are "practices." One of our practices is to inform the Deputy Labor Commissioner I or II that parties scheduled to participate in a conference or hearing that have arrived late or tardy be notified by the Counter Duty person.

This morning, Vicki Tamoush simply hid behind the partition and intentionally failed to notifiy Deputy Labor Commissioner Bruce Broadwater that one of his parties was late, so she let them just sit there in the waiting room while DLC Broadwater unknowingly continued the conference. Mr. Broadwater then discovers the inaction of DLC II Vicki Tamoush and informs DLC III Jorge Gomez about this discourteous treatment to the public. Unfortunately, Bruce Broadwater is talking to someone whose sole focus is to protect the butt-kissing snitch at all costs.

Ain't nuthin' gonna happen to Tamoush: attorney Afgani complains about Tamoush, they give Afgani to DLC II Jackson or DLC II Valdez. Boeing writes a seven-page complaint about DLC II Tamoush; ain't nuthin' happened to her! DLC II Vicki Tamoush intentionally delays Spanish wage claimants so her teacher/translator/pal Mindy receives the sweet $$$$ financial gain for her translating services, and nuthin' happens to Tamoush! Broadwater's concern for the public is falling upon deaf ears, as Jorge Gomez has proven to nurture and care for Vicki Tamoush at all costs. The state fired Watson for similar hearing officer shenanigans, but Tamoush gets a free pass from Senior Deputy Josephine Jorge Gomez, Regional Manager Abby Calva, Deputy Chief Denise Padres, and Labor Commissioner Angela Bradstreet.

Helping the DLSE customer only bites you in the ass, OR, how Vicki Tamoush cried to Jorge Gomez, and how Jorge enables her crying

So I had this wage claim case where the claimant emailed me, asking for a status. I look it up and determine that Santa Ana supervisor Jorge Gomez assigned it to hearing officer Vicki Tamoush, but she had yet to schedule it. I reply to the person and inform them of the status and that Tamoush had the case. I also include her email address because Vicki can handle customer inquiries so long as it does not violate ex-parte communications.

Instead of solving the customer's query, she immediately cries to Jorge about me giving a member of the public her email address. If that wasn't bad enough, Jorge then proceeds to waste my time to discuss the possibilities of not informing the public of the email addresses of state employees. The last time I checked, an email address is the same as a fax or phone number, and if this agency had any earnest desire to serve the public, our email address would be on our business cards, just as the mandated phone & fax numbers. Most of DLSE's managers are either assholes, morons, or cowards. I have no use for them because they're part of the problem, not part of the solution. These morons want to remain in the 18th century, where phones, faxes, computers, (and now) emails are too futuristic for our caveman managers. This is our level of management competence.

Instead of him telling her to serve the public, he doesn't think twice about wasting my time in persuading me to refrain from handing out our email addresses of public servants. At the Santa Ana office, we have two Jorge's: one Jorge treats Vicki Tamoush with baby wipes & kid's gloves, the other Jorge is a real tough guy with Bruce Broadwater, the most successful wage claim settlement deputy Santa Ana has ever had. I want the Jorge that Vicki gets...kinda whimpy, kinda effeminate, kinda soft & squishy. This is the same Jorge that Abby gets. They don't get the tough-guy Jorge like we get.

Hearing Officer Vicki Tamoush refuses counsel into 98a hearing because there wasn't a chair. Rgnl. Mgr. Abigael Calva still does nothing!

While the hearing was taking place, an attorney discussed her concerns (about being refused entry into the hearing) with Jorge Gomez. She's also afraid that Vicki Tamoush will tank the case once Vicki's temporarily yanked from the hearing and given a tongue-lashing by Jorge. So anyways, Jorge pulls Vicki out of the hearing to "talk," and wouldn't you know it...the attorney is quickly ushered into the hearing.

One day after an attorney voiced concerns to supervisor Jorge Gomez about this "chair" incident, her office still looks like a wanna-be court...someone should tell her that she's not a judge! Two chairs for the Plaintiff, two chairs for the Defendant, and tables to make it look like a court-room...how pompous.

It's the classic, "I'm supervisor Jorge Gomez and I let Vicki Tamoush do whatever she wants." Personally, I can comfortably fit 6 people in my office, but hell's gonna freeze over before Jorge Gomez tells Vicki to change her office...and here's the real kick in the sack; he won't do it. Vicki Tamoush treats the public with such contempt; it's unbelieveable that she's allowed to do what she does, but that just Jorge allowing her in having the arrogance to tell an attorney that they are not allowed to participate in their client's hearing becuase of a chair. Nice service to the public.

DLSE Hearing Officer Vicki Tamoush takes a dump on the taxpayers, and the bosses do nothing...what will it take for them to act?

The DLSE's blatant discrimination:

1) Vicki Tamoush screws that taxpayers with delaying Spanish wage claims & hooking up her gal pal Mindy, and Regional Manager Abigael Calva does nothing.

2) Labor Attorney Stephen Afgani makes a formal complaint against Vicki Tamoush, and Regional Manager Abigael Calva does nothing (except to make sure that all Stephen Afgani cases go to Maria Valdez or Jim Jackson).

3) The big taxpaying corporation Boeing makes a complaint against Vicki Tamoush, and Regional Manager Abigael Calva does nothing except to sweep the complaint under the rug.

4) Tamoush plays games with taxpayer money and translator payments, and Regional Manager Abigael Calva does nothing

When Vicki Tamoush complains that someone asked about the make & model of her car, the DIR's Civil Rights Office is involved within 24 hours!

Friday, December 28th: Santa Ana DLSE secretary calls all Plaintiffs and Defendants to inform them that their December 31st hearings with Vicki Tamoush are cancelled. Why Vicki Tamoush decided to cancel all her caseload on New Year's Eve is bullshit, but since there's no policy on internal cancellations, she can screw over the taxpayers with apparently, complete freedom.

Monday, December 31st: one of the Plaintiffs didn't get the voicemail and flew all the way from North Carolina. You think the DLSE is gonna reimburese him for Vicki Tamoush's actions? You think anything's going to happen to that sow of a public servant? Regional Assclown Abigael Calva, if the past is any indication of the future, will probably try to explain the cover up as business as usual. Abigael Calva will protect Vicki Tamoush to Vicki's last Twinkie, and if there is any suffering or unprofessionalism, it will be felt by the taxpayer. The DLSE doesn't give a rat's ass about the public because they allow Vicki Tamoush to act with impunity.

Abigael Calva has known about the problems with Tamoush for years & Abigael Calva won't do sh*t about them. Another complaint made against Hearing Officer Vicky Tamoush, another whitewash/cover-up in DLSE's future

This time, the complaint's been made by Boeing against Vicki Tamoush. Nothing will be done because: a) snitches are protected by the likes of Regional Manager Abigael Calva, and b) suck-ups are protected by the likes of Abigael Calva. What confuses me is that Vicki Tamoush generates more complaints & heartburn for this agency, in comparison to the dirt she dishes the the desk donkies. When she does her counter duty, she purposely sits her fat ass behind a partition, hiding herself from the public, so the public (at the counter) wait longer until her fat ass leaves her chair and acknowledges them. If Regional Dumbshit Abigael Calva has a problem with my description of "fat ass," then she can commence to using a very long tape measure and a Body Mass index for factual accuracy.

For the DLSE, "taking care" of the public is nothing more than a handjob without the happy ending. Actions speak louder than words, and if they refuse to take action against Vicki Tamoush, then they are not serious about providing good, positive customer service to our public. I can bet that the female Labor Commissioner will not send down Bob Brock and Eric Rood to Santa Ana to interrogate the female Vicki Tamoush...that special treatment is saved for DLSE males.

Last year Jim Culbeaux from the IT Department and Dan Nishijima both managers solicited questions from certain individuals with the intent to promote. One such individual named Jefferey Seeman came forward and exposed them. Other individuals such as Jose Nevarez, Jackie Chang and others benefited from these exams.

Did the IT Department loose two employees because of those exams? I heard there were two employees who quit cause they could not tolerate all that is going on here at DIR.

There are heavy staff turnover at the DIR IT Unit under the management of Jim Culbeaux and Dan Nishijima. This is unusual for state. These two managers committed fraud in conducting promotional exams and have been caught. This issue is not resolved by any means.

Let's re-cap: DLSE & DIR managers read this blog, and that includes any manager that that whines about this blog. Now, these managers also have an obligation to forward any allegation(s) for investigation. So this begs the question, what has Labor Commissioner Angela Bradstreet done with these allegations? Is she going to sweep them under the rug, just like dumbshit Regional Manager Abigael Calva protecting Hearing Officer Vicki Tamoush (all these years) with complaints made against her?

Suck-asses and snitches (sub standard employees who cannot stand by their performance) will always be protected by DLSE/DIR managers, and the public continues to suffer from this perverted customer service.

CLICK PIC TO ENLARGE, and what a surprise that Angela Bradstreet did not send this to OD Legal for investigation, but gave it to fellow girl's club member Abigael Calva for proper disposal whitewash. Back in 2002, Deputy Chief Tom Grogan issued a memo that discussed the costs of translators used in the 98a wage claim process. As per current management, that memo still stands. Spanish translators are paid $45 per hour, unless you are a female, work for supervisor Jorge Gomez, and are managed by Abigael Calva.

This one translator worked for 1.25 hours and was paid for 4 hours worth of work. A complaint was filed, and in record time, DLSE Regional Manager Abigael Calva dismissed the complaint, stated that the translator was paid appropriately, and that the hearing officer did nothing wrong. When asked for further details, then all of the sudden Abigael Calva couldn't shut up fast enough. When supervisor Jorge Gomez was asked about this, he said that the translator was working on "other stuff" and that Hearing Officer Vicky Tamoush's recording of time regarding the 1.25 hours was incorrect. He then directed all questions to Abigael Calva, since she was the one that issued the memo that cleared Vicky Tamoush of any taxpayer malfeasance.

Apparently, Labor Commissioner Angela Bradstreet's philosophy of "women helping women" is now being applied to our day to day operations. Is its goal to protect the collective asses of women who screw over the taxpayer and misappropriate taxpayer funds? Through Bradstreet's delegation, Regional Manager Calva did everything she could to protect Hearing Officer Vicky Tamoush; indeed, Vicky Tamoush is protected, and if push came to shove, then it's a safe assumption that Angela Bradstreet would protect Abigael Calva. It also seems that Abigael Calva found a new Lloyd Aubrey.
