The Feces 10 insist upon giving Judge Fell the middle finger by ignoring her order, so now bank accounts and houses will be levied and wages will be garnished upon former Deputy Chief Lupe Almaraz for his violating the blogger's rights. If I steal $20 worth of gas and put it in my private car, I get fired, but if Lupe Almaraz instigates a lawsuit and loses a hundred thousand dollars of the taxpayer's money, then he's promoted to the Chair of the California Agricultural Relations Board at $125,000+ per year....government corruption and kickbacks at its finest.

Manager orders employee to remove management contact information from emails so public is forced to fend for themselves...

Jorge cried to Lotts about DLSE case #68887 because Lotts couldn't remember an email (Lotts sent/rec'd 365+ emails for May, 2008) and Lotts was not required to forward 68887 information to Gomez.  Lotts responds by reminding Gomez that it was Gomez that ordered Lotts to remove contact information about Gomez, Calva, and Padres in his email signature, so the atty. in 68887 could have had the information had Gomez not ordered Lotts to  remove such info.  Instead, Gomez gets the information via snail mail, days later.

It's like the DLSE managers think that email is for their private use and no member of the public should be able to contact them.  These are public officers, who are available to the public from 8am to 5pm, whether it's in person, thru a fax, on the phone, or by email.  Then people wonder why I label them as "FECES."  It's because of crap like this email: DLSE management does not want the public having their contact information: that, will open the floodgates of timelines & memorialization, something very scary to inept managers.

Why doesn't the DLSE have the names, phones, faxes, & emails of specific office management, staff, and support on its website?

Jorge Gomez is the classic DLSE fall-guy, just like Lupe Almaraz, and quite possibly like Denise Padres.  Abby Calva couldn't give a rat's ass, and Angela Bradstreet barely has a handle on what's going on in the offices.  Once she starts making her managers accountable & available to the employees and employers of California, she'll see the results she wants for her career in public service.

The Bureau of State Audits (http://www.bsa.ca.gov/) doesn't do anything, the Attorney General's office won't do squat, so no one's really interested in justice.

Our very own Labor Commissioner Angela Bradstreet wanted DLC Mary Tokar fired immediately, but someone had to tell Bradstreet that public sector is different than private sector, and there are rules. Our own Labor Commissioner didn't know how her own game is played, yet these are the morons who are appointed. Spring time is coming up; let's hope that someone prints out a couple pages of this blog to give to the senators who are in charge of her political appointment.

A huge step in DLSE/DIRt intimidation is to violate their target's right to privacy: thanks to Greg Rupp, Lupe Almaraz, and Richard Munoz

Back when DIRt attorney Richard Munoz was in the Los Angeles DLSE office intimidating witnesses, they made no bones about who the blogger was. The DLSE issued memos that identified who the blogger was, and that the blogger was involved in litigation with the DLSE.

What they forgot to include in their memo was that the DLSE violated the United States Constitution, and the blogger only had the court to tell the the DLSE to "stop." Honestly, what court is going to say that the DLSE can command an employee to submit private diaries and confidential sources? If anyone looked seriously at the legal issues, it's not really about the blog; it's what they tried to demand. Why did they demand the diaries and confidential sources? Because DIRt wants to harass, intimidate, and retaliate against those who dared to speak freely.

Can you imagine if Regional Manager Susan Nakagama filed a sexual harassment lawsuit against Art Lujan, or Assistant Chief Greg Rupp filed a sexual harassment lawsuit against Dean Fryer, and then the DLSE commenced to issuing memos, informing & educating state employees of such litigation? Because it was the blogger, someone seemed to think that violating the blogger's privacy was/is perfectly acceptable. Yes, litigation is a matter of public record, and yes, the DLSE, as a state agency, had a duty to protect the state employee's privacy. Litigation does not absolve them from their duty to keep personnel matters confidential; furthermore, their actions forced me to litigate their violations.

This is the California agency charged with protecting employees from employer abuses, so if this is how they treat their own, then how much do you think they care about protecting outsiders?

03/22/08 Sunday-Los Angeles Times story on car wash workers: their plight, who investigates the car washes, and what-if any-aftermath?

The LA Times has the front-page story (http://www.latimes.com/news/local/la-me-carwash23mar23,0,3592975.story) on car wash workers and their lower-than minimum wage plight; the lack of success concerning the "inspectors" among DLSE, and the overall grim picture of how the rich stay richer and the poor stay poorer. Los Angeles Times reporters Sonia Nazario (sonia.nazario@latimes.com) and Doug Smith (doug.smith@latimes.com) need to dig a little deeper. Some items that Ms. Nazario and Mr. Smith should request in their Public Records Act request to DIRt:
1) How many times California peace officer/EEEC Dir. David Dorame DDorame@dir.ca.gov has been arrested/convicted for driving under their influence, how many of those occasions involved state vehicles, and how he was able to pass his peace officer background investigation (hint: talk to Los Angeles DLSE Asst. Chief Greg Rupp GRupp@dir.ca.gov).
2) Out of all the citations issued against car wash businesses, how many citations have been paid, how many have been appealed, how many have upheld/lost their appeal, and how much money has been collected....versus what citation amounts were issued. How many car wash licenses have been revoked? How many bad car washes have been put out of business because they broke state law(s)?
3) How many "inspectors" assigned to car wash inspections receive bi-lingual (Spanish) pay by the state for speaking Spanish? How many have been trained by the state to study Spanish? It's pretty hard to ascertain violations if there's no one able to elicit/solicit labor law violations by those whose main/only language is Spanish.
4) After DLSE Deputy Chief Lupe Almaraz was found guilty (and liable) to have violated an employee's First Amendment rights, why was he immediately promoted to chair the Agricultural Labor Relations Board?
5) Why won't three DIR attorneys (John Duncan JDuncan@dir.ca.gov, Robert Roginson RRoginson@dir.ca.gov, Angela Bradstreet ABradstreet@dir.ca.gov), and one LWDA Secretary Victoria Bradshaw Victoria.Bradshaw@labor.ca.gov ) provide details on the taxpayer-paid, multi-million dollar computer software disaster known as CMS, contracted out to Hansen/Unisys? If they don't care about the millions of taxpayer dollars (supposedly held in their fiduciary trust), then what makes anyone think that these Schwarzenegger political appointees care about a bunch of workers who cannot contribute to those in political power?

Here's the rumor heard around the water cooler: historically, there's always big investigations in DLSE Public Works/Prevailing Wage in a Democratic administration and the exact opposite in a Republican adminsitration. This current Republican government (Gov. Schwarzenegger, LWDA Secretary Victoria Bradshaw (Victoria.Bradshaw@labor.ca.gov), Deputy Secretary Robert Jones (Robert.Jones@labor.ca.gov), former Jose Millan, DIR Director John Duncan (JDuncan@dir.ca.gov), et al) has "inspectors," who aren't fluent in Spanish, attempting to interview to Spanish workers. Sometimes such cases are closed due to no violations found.

Until Mr. Smith and Ms. Nazario have a complete understanding of the dysfunction of the DIR and DLSE, then the total picture is incomplete.

What would happen if Badstreet, Bradshaw, Fryer, Culbeaux, & Holton were in charge of the DMV.....

Several months ago, I asked a certain jackass as to why the DLSE has failed to post overtime, commission, and vacation supplemental attachments to the wage claim website, since Labor Commissioner Jackass Badstreet wants "perfected" claims to adhere to the effing she received in the Corrales decision. To this date, Badstreet hasn't done sh*t to comply with Corrales: she's about as useless as pearls on a pig....oops, sorry Angela.

To this date, the A-holes have ignored my request in improving customer service to those filing claims related to vacation, commisions & overtime...like it affects the one supplying the helpful hint. This is about her absolute failure in taking care of the People of California, but since employers don't use these supplemental forms, and our Division has been staffed with pro-employer political appointee butt-licks, there isn't much hope that an employee will get the kind of customer service that employers receive.

The A-holes have continued to ignore this issue, even though I also raised this issue when that other jackass, Lupe Almaraz, gave his dipsh*t atta-girl/atta-boy speech at the 2006 Van Nuys Wage Claim training (that really wasn't training). Here's a hint, management losers-don't tell me that you appreciate my work: just shut your mouths (no one wants to hear your crapola) and do what's in the best interest of the Division, not your careers. I've never met a bigger bunch of candy-assed losers in my life.

CMS still sux: desk donkies refuse to punish those involved, & misc. news

1) CMS, that multi-million dollar, taxpayer-paid bullshit software package still doesn't work and DLSE won't discipline the assholes involved with this fraud, waste, and abuse of taxpayer funds...millions of dollars & years later and it's still useless. Newly installed Labor Commissioner puppet Angela Bradstreet's current hot flash is conforming to deadlines after the Corrales beat-down; she should (at least) terminate DLSE Assistant Chief Greg Rupp for having treated the hundreds/thousands of wage claimants with incompetence, inefficiency, and discourteous treatment as a result of violating the 14th Amendment of the United States Constitution, or does Greg Rupp need to violate more parts of the US Constitution before he gets (so much as) a counseling memo? When will other lawyers file a class action lawsuit against Greg Rupp, Jose Millan, & the DLSE on behalf of all those wage claimants?

Until Labor Commissioner Angela Bradstreet formally holds the CMS actionables accountable and brings formal charges against Greg Rupp for his actions described in the Corrales decision, she's just another idiot GAS (Governor Arnold Schwarzenegger) political appointee who is here to only serve her master(s)...not the people of California. I don't give a rat's ass about excuses as to why things are not getting done: someone's a part of the problem until they're a part of the solution...tick tock, tick tock.

2) When you have a hearing officer (Deputy Labor Commissioner 2) that has been blackballed by two Spanish translators, what the public has is a problem. You have a supervisor that's unaware of a negative undercurrent because no one talks to him/her, so their thinking is that there are no problems. This is the same Hearing Officer that's been quoted as saying: "they don't pay me enough money to work the counter and issue work permits." How's that attiutide for public service? It doesn't really matter because DLSE management doesn't give a sh*t about helping the public; their only priority is to serve their own careers or serve their political masters. Hearing Officers can treat translators like sh*t because they know the boss will not do sh*t to them; they have nothing to fear.

3) A wage claimant complained about some DLSE office having a party, so naturally Abby wastes time by making a mountain out of a molehill. Instead of the telling the citizen that they were wrong, Abby makes much ado about nothing. Why? Because she doesn't know how to manage, she distrusts those that she supervises, and she's got nothing better to do. This is who former DLSE Deputy Chief Lupe Almaraz delegated to assist in the Corrales problem, and who chose him? Was it our new Labor Commissioner Angela Bradstreet? How close are we to fixing that problem? Ferchrist, we can't (even) get Hearing Officers to refrain from pissing off translators, so how are we gonna concentrate on things that matter to the public?

Regional Manager Abigael Calva basically craps herself freaks out whenever someone bitches complains to Headquarters or any political office connected to GAS. She assumes that her staff is guilty and never takes care of her staff. No one likes her, as she is disloyal to those who work under her. She doesn't care because...there is no reason; she just doesn't care. She only looks out for herself, which is the real mission statement of the DLSE: "Look out for yourself & kiss the asses of those who can promote you: screw the public if necessary by wasting taxpayer dollars, state equipment, state resources, and state time." Abby's probably driving around in her taxpayer-paid new Impala, commuting from Pasadena to Los Angeles, sitting at her desk, not going anywhere. Why? Because she's a hooked up bureaucrat: no one's gonna take away her free car, free parking, and free gas. She's paid her dues: she's entitled to a free car, free parking, and a free commute...the public owes her and damn it, she's gonna take it. She's not even Field Personnel but she gets a new Impala to drive to & from her $million+$ house in Pasadena! Classic DLSE dysfunction & hypocracy.

If Angela Bradstreet wants to start serving the public, she can start by overhauling this agency and conducting formal efficiency audits in every area of this division; otherwise, she can try and sell it to those who will confirm her appointment. Abby Calva's about as useful to the DLSE as a pearl necklace is to a pig.

Violate the United States Constitution, and Governor Schwarzenegger promotes you in his administration: now it's Lupe Almaraz

I heard that Lupe retired because he hated working for Angela, and Angela thinks that Greg Rupp is dumb & worthless..she hates Greg Rupp. I also heard that John Rea was the #1 butthole that supervised Denise Padres' Hartwig decision. John Rea had to make sure that Hartwig was perfect before it was published. I've also been told that Angela Bradstreet's senate confirmation will be sometime in Spring, 2008. Deputy Labor Commissioner Mary Tokar retires, Santa Ana DLSE Office has 3.5 wage claim staff (normally 7) to handle Corrales conferences

It seems that Labor Commissioner Bradstreet seems to be driving people away; I wonder what numbers she can produce on employment levels, comparing what they were to what they are. In any event, I'm sure she'll have a good excuse as to why she's failing & not getting the job done...she seems to be an excellent excuse-maker.

With DLC Mary Tokar retiring, the Santa Ana office continues to operate at an unsatisfactory and a substandard level, not that the DLSE has any standards!

The public continues to receive a disservice because the management jackasses (Angela Bradstreet, Abigael Calva, Lupe Almaraz) continuously fail to anticipate what's around the corner. Having settlement conference deputies at 50% capacity (3.5 versus 7) means that the public gets f*cked: the public unnecessarily wait longer, justice delayed is justice denied. It's as if Angela Bradstreet thinks of the Corrales decision as something to wipe her ass with, because she's not helping the taxpayer with her lame-ass band-aid memos. She gives the Santa Ana office 7 permanent, wage claim officers (instead of the 3.5), and that will go a long way toward getting rid of her Corrales headache.

I know that law school doesn't have a class in Common Sense; it's something one picks up in the streets and in dealing with regular people. I know it must be hard for Angela Bradstreet to make decisions for the common people while sitting atop her ivory tower in Saulsalito. She should go hang in the Tenderloin, Mission District, or Hunter's Point sometime...but she might be too afraid to leave her limo.

The 4 Monkeys (Bradstreet, Almaraz, Calva, Rood) who authored this memo never stated that they would provide fully-staffed personnel to ensure Corrales deadlines, they discuss "perfected" claims as if only claims that are 'perfect' are eligible. They write about the "simplified issues worksheet" but fail to ideintify which DLSE Form # to use, or is it some renegade, underground form that's not DLSE-approved? The 4 Monkeys want staff to make 2 phone calls and memorialize the calls (time wasting), then they want us to waste more time by faxing & emailing the notice of wage claims (DLSE Form 563). Emailing the DLSE Form 563 will be difficult, as there's no f*cking support software to take a File Maker Pro document and convert into a .pdf file to be used as a universally safe email attachment. There's not (even) a scanner to print the DLSE 563. and convert it manually for emailing. These 4 Monkeys could not be any dumber! I'd like to see any one of these Monkeys actually do what they want their staff to do!

The 4 Monkeys also want supervisors to approve the Transmittal (DLSE Form 540) within 72 hours [what if the Transmittal is not perfect?], they also want to use approved overtime to reduce backlogs....that's nice, except that there's no overtime to be used! All excess money is devoted to supervisor retreats meetings in Santa Clara (or The Atrium in Irvine) where they receive paid air fare, lodging, per diem, & meals!

These morons have caused a large amount of money to be taken away from the taxpayers. If Angela Bradstreet thinks that this will not surface during her senate confirmation hearings, then she's higher than a kite. I offered her a chance to fix this, and she thumbed her nose at the taxpayer, just like she thumbed her nose at the taxpayer with her stupid CMS "keep the faith" memo and her stupid Let's-email-stuff-to-Defendants Corrales memo.

Bradstreet's a moron, and what's even worse...the people (she listens to) are morons. In order for her not be labled as stupid, she's gotta decide & act on something that doesn't (inevitably) butt-rape the taxpayer in the process. Potted plants do much less damage to the taxpayer.

Blogger's dragged back into court on November 21st

So this is how it played out; the judge issued a proposed decision. The money-wasting, court-clogging turds at OD-Legal decided to cry & whine about it like the babies that they are. They could have let the decision stand and later appeal it, but that would take legal smarts. These retards cannot (even) figure out how to count for a summary judgement deadline, so I shouldn't be surprised that these ass-clowns cried about an uninvolved 3rd party not seeing it their way.

In a way, I hope these morons give me the opportunity to be heard at the appeals court; it only gives me another chance to fight & win...you'd think these morons would stop sticking their hand in the fire, but dumbasses never learn. That's why they are dumbasses.

Though word's been sent to Dudley-Do-Right, if they want to stop losing, here's the offer (in order of preference):

1. Pay legal fees and leave me alone to serve the public

2. Pay legal fees and place me on 18-month paid admin leave (this is nothing compared to the waste of the multi-million dollar abortion called CMS)

3. Continue to violate my rights and continue to lose

Youth, drive, and assets go a long way. If they really wanted to show good faith, they could terminate DLSE Assistant Chief Greg Rupp and DLSE Deputy Chief Lupe Almaraz for their consitutional retardation and divert the money saved in their salaries to those that have suffered from their lawlessness.

Lupe Almaraz retires, DLC III exam in LA, Supervisor's retreat meeting in Nor Cal, info request on Culbeaux & Baker

DLSE Deputy Chief Lupe Almaraz sent Labor Commissioner Angela Bradstreet his resignation letter; he's set to go away on 12/31/2007. At the end of the day, he did nothing for this department except spike his retirement paycheck...once again, screwing over the taxpayers! After Lupe's gone, ain't nobody named to be in charge of Wage Claims. It would be nice to see Nance Steffen come back as the Wage Claim Assistant Chief, but she's only going to get the blessing of staff by removing Regional Manager Abigael Calva's taxpayer-paid commute vehicle from Calva's possession.

The taxpayers don't need to pay for Calva's commute. CASE IN POINT: her lazy ass, having a state vehicle assigned to her, made Deputy Labor Commissioner Bruce Broadwater drive from Santa Ana to Los Angeles to discuss an item of importance. He had to use his car & his mileage even though the state gives her a vehicle of her own. Normally, if state auditors would ask WTF(?) she does with her car, she'd tell them that as Regional Manager, she's responsible for all these offices in So Cal...total bullsh*t. Her lazy ass goes nowhere and makes her staff come to her. Typical, lazy, bureaucratic, cow.

The recent Deputy Labor Commissioner III (DLC 3) exam came down to So Cal. Here's my prediction: they will pass & pick whoever they want to pass & pick because these assholes do not know how to keep themselves in check. Ferchrist, the State Personnel Board provides no oversight, and even when the California Supreme Court provides their oversight in their Corrales decision, Labor Commissioner Angela Bradstreet does nothing to Greg Rupp-the whore (at the time) for Jose Millan who screwed over all those wage claimants & violated their due process. These douchebags cannot self-regulate, and we're supposed to think that they'll righteously promote someone from a merit-based exam? They can't (even) follow laws, much less policies.

Last but not least, the desk donkies wasting money from the taxpayer's bank accounts opened the spigot for the supervisor's meeting in Nor Cal (11/04-06/2007). Now, these money wasters justified expeditures like video conferencing in offices so that they can hold meetings via video conferences. Why must they waste more money on airline tickets, lodging, meals, and time? We need computer software like Adobe Acrobat and scanners, but these money wasters sit around for three days, butt-kiss, and bray like an old goat about how to make the system worse. The Taxpayers get dry-humped again; this time in Santa Ana

A Labor Code 98a wage claim hearing was scheduled at 8:30am on 11/07/2007 in Santa Ana with a Hearing Officer. It was cancelled & re-scheduled at the last minute because the hearing officer wanted to take a vacation day. This Hearing Officer also had Counter Duty, and it's the store's policy to have a replacement on counter duty, but not when calling in sick. The people who showed up for the hearing, took time out of their day, and paid for parking? They got the big, fat middle finger from this public agency.

In the end, the state will spend more money on this re-schedule, the case load will be backed up because this case didn't get heard, and nothing will happen to the hearing officer because butt-kissers & snitches are protected in this agency.

Screw the taxpayer, the butt-kissing/snitch hearing officer must be protected. Regional Manager Abigael Calva will do nothing, and neither will Deputy Chief Lupe Almaraz. Welcome to Labor Standards.

DLSE supervisor exam to be held in Los Angeles, mid-November: the bat guano referred as DLSE execs. begin their biased, unfair, & traditional testing!

Well, it's time for the good ol' girls club at DLSE (Greg Rupp and Lupe Almaraz included) to start their biased, unfair, predetermined supervisor's exam. At the last supervisor's exam (DLC IV), how did some friggin' noob like Eric Rood (dink bureaucrat hailing from EDD) manage to pass the exam & promote to Regional Manager while seasoned supervisors failed the same exam? Yeah, tell me that the DLC IV exam was fair & unbiased.

Here's the real kick in the grapes: the DLSE doesn't (even) attempt to appear fair, which is the very purpose of the merit-based, civil service exam. The civil service exams & promotional qualifications appraisals' purpose are supposed to eliminate this kind of crap, yet all it does is shield the guilty from the microscope.

Why is California's State Personnel Board not up DIR's butt as to why such exams are continuing? These DIR retards have proven, to themselves and others, that they will not self-correct. It is the managers that need constant supervision, and it is the managers who need to be investigated. Why are Deputy Chief Lupe Almaraz and Assistant Chief Greg Rupp still collecting paychecks, after placing California taxpayers in harm's way? Why have they not been disciplined and investigated for their actions against the citizens of California? Does Labor Commissioner Angela Bradstreet need more communications from Assembly Members to get off her lazy ass and take action? What's her major malfunction?

Come mid-November, the Kabuki Theater called the DLSE supervisor exam will go thru the motions, and then pass & pick whoever they want to pass and pick. If the State Personnel Board fails to supervise the DLSE, then are they just as liable?

CMS is the biggest boondoggle this division has seen since entering the 21st century; our latest Labor Commissioner has seen fit to continue this multi-million dollar, taxpayer-paid fiasco instead of halting this fiscal hemorrhage.

Our latest Labor Commissioner seems to only be in the news when generating citation news releases as to how she's cracking the whip with those darn sweatshops or when reporters highlight how her appointment may be less-than political and more of another type of appointment.

Our Labor Commissioner has a ruling issued by the California Supreme Court discussing how DLSE Assistant Chief Greg Rupp violating the 14th Amendment of the United State Constitution, and what does she do? She doesn't do anything, she just sits on her ass and does nothing.

Bradstreet's lame (and few) press releases about issuing citations to non-donators/non-lobbyists are boring: any monkey can write a citation (versus the 'hard' statistics on citations paid, citations to collections, citation appeal hearings won/lost, etc.). This division is a failure because the people at the top are a failure; they are failing the taxpayers of this state, and no one (at the top) gives a rat's ass.
