Back when DIRt attorney Richard Munoz was in the Los Angeles DLSE office intimidating witnesses, they made no bones about who the blogger was. The DLSE issued memos that identified who the blogger was, and that the blogger was involved in litigation with the DLSE.

What they forgot to include in their memo was that the DLSE violated the United States Constitution, and the blogger only had the court to tell the the DLSE to "stop." Honestly, what court is going to say that the DLSE can command an employee to submit private diaries and confidential sources? If anyone looked seriously at the legal issues, it's not really about the blog; it's what they tried to demand. Why did they demand the diaries and confidential sources? Because DIRt wants to harass, intimidate, and retaliate against those who dared to speak freely.

Can you imagine if Regional Manager Susan Nakagama filed a sexual harassment lawsuit against Art Lujan, or Assistant Chief Greg Rupp filed a sexual harassment lawsuit against Dean Fryer, and then the DLSE commenced to issuing memos, informing & educating state employees of such litigation? Because it was the blogger, someone seemed to think that violating the blogger's privacy was/is perfectly acceptable. Yes, litigation is a matter of public record, and yes, the DLSE, as a state agency, had a duty to protect the state employee's privacy. Litigation does not absolve them from their duty to keep personnel matters confidential; furthermore, their actions forced me to litigate their violations.

This is the California agency charged with protecting employees from employer abuses, so if this is how they treat their own, then how much do you think they care about protecting outsiders?

During this governor's budget crisis, the legal team of the DIR rec'd approval to appeal the judge's decision in blogger's constitutional protections

My lawyer just rec'd the appeal paperwork today, which means that the turds at OD-Legal received financial approval to continue this fight. More intentional taxpayer waste, more taxpayer-paid abuse & misuse of state time, resources, and money. Judge Fell allowed everything they (basically) wanted into court record, and the babies are still crying to have their appeal.

I don't want to hear about Governor Schwarzenegger's financial woes when he's appointing constitutional violators like Lupe Almaraz to a do-nothing position at $132,000+ per year, nor do I want to hear about our agency whining about unfilled positions due to budget woes.

Almaraz is a Democrat."

1. "A proclivity for developing grandiose strategies with little thought toward their implementation." These DLSE people assume that others at lower levels will magically turn strategy into reality. This is what makes the Bradstreet Corrales memo a total joke. She doesn't say sh*t about bringing critical offices up to authorized staffing levels; in fact, she wants the few people (still) working to make idiot phone calls because the Santa Barbara office supervisor has time to sit on his ass and telephonically harass defendants into settlements.

2. "A reputation for forcing programs down the throats of reluctant staff." These DLSE people need to be consensus builders, and they need to be many more things. Labor Commissioner Angela Bradstreet is attmepting to shove CMS down our throats, managers who violate the US Constitution down our throats, and "her way" of fixing Corrales down our throats.

At the end of the day, she deludes herself into thinking that more rules and more regulations will magically turn into faster case resolution...WTF? More rules and more regulations mean more work to be done and less results. Did she have a logics class at law school? Did she pass it?

These morons have caused a large amount of money to be taken away from the taxpayers. If Angela Bradstreet thinks that this will not surface during her senate confirmation hearings, then she's higher than a kite. I offered her a chance to fix this, and she thumbed her nose at the taxpayer, just like she thumbed her nose at the taxpayer with her stupid CMS "keep the faith" memo and her stupid Let's-email-stuff-to-Defendants Corrales memo.

So this is how it played out; the judge issued a proposed decision. The money-wasting, court-clogging turds at OD-Legal decided to cry & whine about it like the babies that they are. They could have let the decision stand and later appeal it, but that would take legal smarts. These retards cannot (even) figure out how to count for a summary judgement deadline, so I shouldn't be surprised that these ass-clowns cried about an uninvolved 3rd party not seeing it their way.

In a way, I hope these morons give me the opportunity to be heard at the appeals court; it only gives me another chance to fight & win...you'd think these morons would stop sticking their hand in the fire, but dumbasses never learn. That's why they are dumbasses.

Though word's been sent to Dudley-Do-Right, if they want to stop losing, here's the offer (in order of preference):

1. Pay legal fees and leave me alone to serve the public

2. Pay legal fees and place me on 18-month paid admin leave (this is nothing compared to the waste of the multi-million dollar abortion called CMS)

DLSE supervisor exam to be held in Los Angeles, mid-November: the bat guano referred as DLSE execs. begin their biased, unfair, & traditional testing!

Well, it's time for the good ol' girls club at DLSE (Greg Rupp and Lupe Almaraz included) to start their biased, unfair, predetermined supervisor's exam. At the last supervisor's exam (DLC IV), how did some friggin' noob like Eric Rood (dink bureaucrat hailing from EDD) manage to pass the exam & promote to Regional Manager while seasoned supervisors failed the same exam? Yeah, tell me that the DLC IV exam was fair & unbiased.

Here's the real kick in the grapes: the DLSE doesn't (even) attempt to appear fair, which is the very purpose of the merit-based, civil service exam. The civil service exams & promotional qualifications appraisals' purpose are supposed to eliminate this kind of crap, yet all it does is shield the guilty from the microscope.

Why is California's State Personnel Board not up DIR's butt as to why such exams are continuing? These DIR retards have proven, to themselves and others, that they will not self-correct. It is the managers that need constant supervision, and it is the managers who need to be investigated. Why are Deputy Chief Lupe Almaraz and Assistant Chief Greg Rupp still collecting paychecks, after placing California taxpayers in harm's way? Why have they not been disciplined and investigated for their actions against the citizens of California? Does Labor Commissioner Angela Bradstreet need more communications from Assembly Members to get off her lazy ass and take action? What's her major malfunction?

Come mid-November, the Kabuki Theater called the DLSE supervisor exam will go thru the motions, and then pass & pick whoever they want to pass and pick. If the State Personnel Board fails to supervise the DLSE, then are they just as liable?

Labor Commissioner Angela Bradstreet's burn-taxpayer-funds & do-nothing approach to this job

CMS is the biggest boondoggle this division has seen since entering the 21st century; our latest Labor Commissioner has seen fit to continue this multi-million dollar, taxpayer-paid fiasco instead of halting this fiscal hemorrhage.

Our latest Labor Commissioner seems to only be in the news when generating citation news releases as to how she's cracking the whip with those darn sweatshops or when reporters highlight how her appointment may be less-than political and more of another type of appointment.

Our Labor Commissioner has a ruling issued by the California Supreme Court discussing how DLSE Assistant Chief Greg Rupp violating the 14th Amendment of the United State Constitution, and what does she do? She doesn't do anything, she just sits on her ass and does nothing.

Tiffany Rystrom is Angela Bradstreet's domestic partner, who heads up the state's Public Employment Relations Board, and that position pays $123,897 a year. Susan Kennedy is GAS' Cheif of Staff. Susan Kennedy and Vicki Marti share a home in Fairfax. Ties between the Gov. Arnold Schwarzenegger administration and Marin Services for Women of Greenbrae are being scrutinized because the domestic partner of Schwarzenegger's chief of staff, Susan Kennedy, is a longtime employee of the nonprofit.

Schwarzenegger has kept Vicki Marti on the California Medical Assistance Commission even though her term expired in January 2005. The position pays $54,250 a year. In February, the governor appointed Renee Zito, the former director of programs at Marin Services for Women, as director of the state's Department of Alcohol and Drug Programs. The position pays $142,965 a year.

It seems to me that if you want a really high political appointment under GAS, it really helps to be connected at the Marin Services for Women of Greenbrae, and it also seems that your sexual preference must be lesbian. Now, before everyone starts crying and wiping their eyes with rainbow flags, let me make one thing perfectly clear. I'm all for gay rights in this state. If Angela and her crew had any real courage, they would demand from their Governor (their boss)that gays must have the same rights as straights, especially marriage. As we know, GAS is not the People's Governor, because gays are people, too, and gays want to be married just like straight people, well - GAS stopped that legislation dead in its tracks. I bet if he was gay, then gays would be legally allowed to marry.

What the problem here is that once again, cronyism and favoritism dictate political appointments in state service, and it doesn't matter if it's (previously) from some fat, old, dumb, straight white guy like Greg Rupp or a (current) lesbian who knows people in really high places. The point is that the best person is not selected for the job, and that's how the taxpayers get screwed. This is our current Labor Standard: hang with lesbians, get kick-ass political appointments.

Ask yourself this question, why are multi-millionaires (like those mentioned above) coming down to such lowly positions like state political appointments? Couldn't they sit on their asses and collect bigger paychecks by doing nothing at their old jobs? Why must they come here for lower pay, do nothing, and screw the taxpayer for such shitty service? Santa Ana still has no safety barrier - unlike our Labor Commissioner, that multi-million dollar taxpayer-paid abortion called CMS is deader than Susan Nakagama's career, Lupe Almaraz & Greg Rupp have yet to be punished for violating our United States Constitution, and Ms. Angela Bradstreet refuses to get off her lazy ass and actually do something about that Corrales beat-down she suffered at the hands of the California Supreme Court. Can you imagine if Vanessa Holton had to personally tap Lloyd Aubrey's bank account to fund this witch-hunt? The only person that controls both EDD & DLSE is Secretary Victoria Bradshaw...and I do mean Secretary. There are DLC IIIs that have spent decades doing the job, and the DLSE cannot devise an exam where the best DLC IIIs pass an exam, and some newbie passes it? Yeah, I'm sure it wasn't rigged! And to the DLC IIIs who failed the exam & have given decades of dedicated service to the DLSE: the higher-ups think that you are dirt and chumps. "You will continue to be dumped on because that's what we think of your service. New guys like Eric Rood will get the promotion because that's how we roll. You don't like it? Quit. Loyal morons like Deputy Chief Lupe Almaraz still get named as Defendants in losing lawsuits, but promoting him to Deputy Chief was (still) the better choice than promoting that other asshole Assistant Chief Greg Rupp. Of course, only both of them have been named by judges for failing to read the US Constitution & understand what was written over 200+ years ago. In a case that will eventually cost in the hundreds of thousands of dollars, these public servants (Victoria Bradshaw, Vanessa Holtom, John Rea, Robert Jones, Steve McGinty, Richard Munoz, Anthony Mischel, Greg Rupp, and Lupe Almaraz) have failed their obligatory duty.

The DLSE's GAS republican agenda current mission seems to politicize wages and devise ways for employers to circumvent those nasty little things called labor laws. Lawful employers have no problem with the laws on the books; only the law breakers are pissed off about meal and rest periods, overtime, minimum wage, and mandatory workers compensation insurance.

Here we have a division that fought a free speech case and lost, but they didn't lose their money. They lost the public's money: ergo, they lost your money. They don't care about losing your money because it's not their money. These public officers are incompetent, inefficient, and deserve to have their jobs taken away from them. They do not deserve to serve the public anymore, as they have demonstrated that they have zero fiduciary duty to the taxpayer. These people are probably arrogant enough to keep fighting; I welcome the opportunity to beat them again and again. Let them appeal, spend more of the public's money and lose. I welcome the chance to show these documents at Angela Bradstreet's and Robert Jones' senate confirmation hearings. Who's the new DIR Director-Duncan, is it? He can join this party, too.

By the way, Steve McGinty and Richard Munoz are some of the best tools OD-Legal attorneys in state service. They rank (right up there with) OD-Legal attorneys Anthony Mischel and Vanessa Holton. I think all four of them are a total joke, and their legal failures prove it. They'll keep losing and I'll keep broadcasting...they ought to stop using the public's money in pursuing a non-mission DLSE legal battle. Save the money for CMS lawsuits. What really burns my ass is the Governator, he actually has the stones to post on his website that he's "The People's Governor."
