Santa Ana Deputy Labor Commissioner refused business cards; so far, no one charged, arrested, or disciplined for taxpayer-paid CMS millions-$ thievery

These are the official fecal matters of DIR, DLSE, and LWDA: Richard Munoz, Anthony Mischel, Vanessa Holton, Steve McGinty, Angela Bradstreet, John Rea, John Duncan, Robert Roginson, Robert Jones, Victoria Bradshaw: otherwise known as the Feces 10.  Most are lackey lawyers or political appointees, thus adding to their stink.

They do nothing to the guilty parties of CMS, the taxpayer-paid, multi-million dollar abortion that's officially listed as junk.  Not one *sshole has been charged/disciplined with that fiasco, but some DLC cannot order business cards because there's no money to pay for them.  No oversight, no accountability, and certainly no responsibility taken for CMS.  Not one of Feces 10 will provide any real numbers as to the true cost of CMS to the taxpayer.  The Feces 10 will continue to do what they do best, collect their paychecks, stink up the joint, and provide a disservice to the taxpayers of California

A huge step in DLSE/DIRt intimidation is to violate their target's right to privacy: thanks to Greg Rupp, Lupe Almaraz, and Richard Munoz

Back when DIRt attorney Richard Munoz was in the Los Angeles DLSE office intimidating witnesses, they made no bones about who the blogger was. The DLSE issued memos that identified who the blogger was, and that the blogger was involved in litigation with the DLSE.

What they forgot to include in their memo was that the DLSE violated the United States Constitution, and the blogger only had the court to tell the the DLSE to "stop." Honestly, what court is going to say that the DLSE can command an employee to submit private diaries and confidential sources? If anyone looked seriously at the legal issues, it's not really about the blog; it's what they tried to demand. Why did they demand the diaries and confidential sources? Because DIRt wants to harass, intimidate, and retaliate against those who dared to speak freely.

Can you imagine if Regional Manager Susan Nakagama filed a sexual harassment lawsuit against Art Lujan, or Assistant Chief Greg Rupp filed a sexual harassment lawsuit against Dean Fryer, and then the DLSE commenced to issuing memos, informing & educating state employees of such litigation? Because it was the blogger, someone seemed to think that violating the blogger's privacy was/is perfectly acceptable. Yes, litigation is a matter of public record, and yes, the DLSE, as a state agency, had a duty to protect the state employee's privacy. Litigation does not absolve them from their duty to keep personnel matters confidential; furthermore, their actions forced me to litigate their violations.

This is the California agency charged with protecting employees from employer abuses, so if this is how they treat their own, then how much do you think they care about protecting outsiders?

I don't know if this guy is just an idiot that assumes the position of prison wife every time he's given a directive, or if he truly believes that his crap smells like roses. In any event, he's either a total imbecile or a retarded bagman.

During this governor's budget crisis, the legal team of the DIR rec'd approval to appeal the judge's decision in blogger's constitutional protections

My lawyer just rec'd the appeal paperwork today, which means that the turds at OD-Legal received financial approval to continue this fight. More intentional taxpayer waste, more taxpayer-paid abuse & misuse of state time, resources, and money. Judge Fell allowed everything they (basically) wanted into court record, and the babies are still crying to have their appeal.

I don't want to hear about Governor Schwarzenegger's financial woes when he's appointing constitutional violators like Lupe Almaraz to a do-nothing position at $132,000+ per year, nor do I want to hear about our agency whining about unfilled positions due to budget woes.

These fiscal retards created the budget mess, these political turds decided to violate the US Constitution, and these bureaucratic jackasses couldn't resolve their way out of a paper bag.

Blogger's dragged back into court on November 21st

So this is how it played out; the judge issued a proposed decision. The money-wasting, court-clogging turds at OD-Legal decided to cry & whine about it like the babies that they are. They could have let the decision stand and later appeal it, but that would take legal smarts. These retards cannot (even) figure out how to count for a summary judgement deadline, so I shouldn't be surprised that these ass-clowns cried about an uninvolved 3rd party not seeing it their way.

In a way, I hope these morons give me the opportunity to be heard at the appeals court; it only gives me another chance to fight & win...you'd think these morons would stop sticking their hand in the fire, but dumbasses never learn. That's why they are dumbasses.

Though word's been sent to Dudley-Do-Right, if they want to stop losing, here's the offer (in order of preference):

1. Pay legal fees and leave me alone to serve the public

2. Pay legal fees and place me on 18-month paid admin leave (this is nothing compared to the waste of the multi-million dollar abortion called CMS)

3. Continue to violate my rights and continue to lose

Youth, drive, and assets go a long way. If they really wanted to show good faith, they could terminate DLSE Assistant Chief Greg Rupp and DLSE Deputy Chief Lupe Almaraz for their consitutional retardation and divert the money saved in their salaries to those that have suffered from their lawlessness.

Well, the morons at OD-Legal are wasting taxpayers funds yet again. Chief homewrecker Counsel Vanessa Holton, Asst. Chief Counsel Steve McGinty, and Flunkie Richard Munoz are crying about the judge's proposed decision. These morons still don't understand the 1st Amendment. They have an endless bank account because it's the taxpayers that are footing the bill!

Can you imagine if Vanessa Holton had to personally tap Lloyd Aubrey's bank account to fund this witch-hunt? Why aren't these morons doing the job that they are paid to do, which is to lose in front of state Adminstrative Law Judges? Oh wait, we don't have the decision on Miles' fate just yet, but it's coming.

Why is the Office of the Director-Legal Unit fighting some dipshit blogger? Why is so much money being thrown at all of these OD-Legal morons, authorized to continue this losing battle? Which #1 moron is authorizing OD-Legal to continue this battle? Is it our top secretary, Victoria Bradshaw? Is it that other moron Robert Jones (who can't read meal & rest periods), or is it someone else? OD-Legal cannot shit in the woods without an instruction manual, so who is pulling their strings? In any event, every time those morons file a court document is just another opportunity for them to get beat. It's too bad that the judge cannot fine them for wasting the court's time and wasting the taxpayer's money for such intentional & consistent losses. Unfortunately for Vanessa Holton, this is not (any sort of) a husband stealing contest; it's a 1st Amendment issue. These jackasses don't care if they continuing losing, because the financial fraud, waste, and abuse is committed upon the taxpayer; not one DIR turd is telling them to halt and to cut their losses, because they have no losses; it's the taxpayer's loss.

I'm not sure if Vanessa Holton took any recent legal ethics classes, but is there any ethical connection to harassing a blogger exercising free speech, unrelated to DLSE's mission and stealing someone else's husband? I'm not really sure, so please have Vanessa click the 'comment' button and pontificate about this possible nexus. Typically, it's been my experience that an asshole at work is an asshole at home, but I'd really need a video camera at Greg Rupp's house to solidify my theory. Having Vanessa Holton as OD-Legal's Chief Counsel is like having Alberto Gonzales as our Attorney General....oh wait.

The harassment of the blogger continues...

The day after the blogger received the judge's decision in the trial against the DLSE & Lupe Almaraz, the DLSE smacked the blogger with another internal affairs investigation meeting set for September 7th.

The interrogators refused to divulge who typed the 8+ pages of single-spaced questions, but newly promoted Regional Manager trainee Eric Rood mentioned OD-Legal in an earlier conversation. If OD-Legal's involved, then you can bet those lard asses Vanessa Holton, Steve McGinty, Richard Munoz, and Anthony Mischel had their hands in this.

The issue involved a complaint sent to the Labor Commissioner because the claimant's case was dismissed at the settlement conference. Earlier, the claimant wrote a letter requesting a telephonic conference because he would be in Missouri. In actuality, the claimant was in Riverside and only packing his belongings to move to Missouri. Sitting at home in Riverside is quite different than being in Missouri, so it was dismissed. The claimant, Bryan Davenport, complained in a letter to the Labor Commissioner. Then, OD-Legal became involved, & then shit rolls downhill! Apparantly, putting coffee mugs in a box is enough for Regional Dumbshit Manager Abigael Calva to authorize a telephonic conference. Calva's given the green light to re-open the case. Maybe Calva's dumb/lazy ass can settle it, since she wants it opened. Her and that other moron Lupe Almaraz can do the DLSE-Wage Claims a huge favor and put a policy into play that explains the procedures and reasons why telephonic conferences should be granted at the settlement process, because right now, Calva & Almaraz have given the DLSE shit.

A complaint like this should have never been escalated to the point where OD-Legal drafted questions for two desk donkies, who then flew down from Nor Cal for this inquisition. By the way, Bob Brock was the same asshole who interrogated Bruce Broadwater about that Vicky Tamoush bullshit complaint against Jim Jackson concerning translators. Interrogate first, drum up/manufacture the evidence later....serving the public and ass-raping taxpayer funds...one inquisition at a time. Thanks to newly-installed Governator appointee Angela Bradstreet, the Labor Commissioner who authorized such taxpayer waste without so much as a smidgen of corroborative evidence before green-lighting and wasting such money.

DLSE has a BOFE manual and a Hearing Officer's manual, but nothing for the settlement conferences. Why does the DLSE practice such inefficiency?

The DLSE has a book for hearing officers and a book for BOFE (Bureau of Field Enforcement), but what these retards don't have is a book for settling conferences.

These retards are wasting state time, resources, and money by focusing on items that are not mission-related, like losing in court to the blogger. Who is authorizing these costs to the taxpayer? Make no mistake that this was their sad attempt at harassment & retaliation, and they (still) couldn't get it right.

If Bradstreet's going to outsource CMS finalization to EDD, then shouldn't she, at the very least, take a big dump on Jim Culbeaux's career?

Just when I think that sanity & reality may return to this division, I read Angela Bradstreet's memo (go to the 'thank-you' paragraph), and I go insane all over again [click this link to read text & pic {click pic to enlarge}]. She thanks some personnel that were/are completely useless, and it looks like she didn't thank the true mastermind of CMS: Jim Culbeaux. Why was his name not in her memo?

What I really love about this blog is that people from Nor Cal are reading it, and if they are really smart, they're passing this link for others to read. It seems that Jim Culbeaux rents out space in Oakland to recently ejected Acting Director John Rea, and there are those that insist that he's the mastermind behind the CMS failure. If that's true, then what's happening to his career? For those that are in the know, please spell it out for us not in the know. How did he get his start? Who protects him and why? What education & specialization does he possess?

If you read Angela's memo carefully, you'll notice how she failed to articulate the total cost, both in dollars and man/woman hours spent on this abortion. The DLSE's GAS republican agenda current mission seems to politicize wages and devise ways for employers to circumvent those nasty little things called labor laws. Lawful employers have no problem with the laws on the books; only the law breakers are pissed off about meal and rest periods, overtime, minimum wage, and mandatory workers compensation insurance.

Here we have a division that fought a free speech case and lost, but they didn't lose their money. They lost the public's money: ergo, they lost your money. They don't care about losing your money because it's not their money. These public officers are incompetent, inefficient, and deserve to have their jobs taken away from them. They do not deserve to serve the public anymore, as they have demonstrated that they have zero fiduciary duty to the taxpayer. By the way, Steve McGinty and Richard Munoz are some of the best tools OD-Legal attorneys in state service. They rank (right up there with) OD-Legal attorneys Anthony Mischel and Vanessa Holton. I think all four of them are a total joke, and their legal failures prove it. They'll keep losing and I'll keep broadcasting...they ought to stop using the public's money in pursuing a non-mission DLSE legal battle. Save the money for CMS lawsuits. What really burns my ass is the Governator, he actually has the stones to post on his website that he's "The People's Governor."
